Terms of Use

This is a plain-language summary for information; the controlling terms are [to be finalized with counsel]. It gives you the shape of the agreement between you and Cabana. It is not legal advice and may be superseded by the definitive Terms of Use published at go-live.

1. Accepting these terms

By using this website or the Cabana services, you agree to these Terms of Use. If you do not agree, please do not use the services. If you use the services on behalf of someone else, you represent that you are authorized to do so.

2. What Cabana is, and isn’t

Cabana is a technology platform that connects patients with independently licensed healthcare providers and pharmacies. Cabana is not a healthcare provider, pharmacy, or manufacturer, and does not practice medicine or dispense medication. Medical services are provided by licensed clinicians of an independently owned and operated Cabana-affiliated medical group. Any prescription is issued only if a provider determines a treatment is medically appropriate for you. No prescription is guaranteed, and completing an intake or purchasing a membership does not entitle you to any particular medication.

3. Not medical advice; not for emergencies

Content on this website is for general informational purposes only, is not medical advice, and does not create a doctor-patient relationship. Cabana is not an emergency service. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

4. Eligibility

You must be 18 years of age or older and a resident of the United States located in a state where the services you request are available. Products and services are not available in all states, and availability of specific treatments, especially controlled substances such as testosterone, may vary based on where you are located. We confirm what is available to you during intake.

5. The clinical relationship and consents

If you pursue treatment, you will enter into a relationship with a licensed provider and may be asked to agree to additional consents, including our Telehealth Informed Consent. Your provider exercises independent clinical judgment, may require lab testing and a video visit, and may decline to prescribe.

6. Memberships, billing, and cancellation

Cabana is a cash-pay service; we do not bill insurance. Memberships and programs may renew automatically. Before you are billed, we disclose the total cost (including medication where applicable), the renewal date, and the auto-renewal terms. You can cancel anytime through your account or by contacting your concierge; we will not obscure the cancellation process. Refunds are governed by our Shipping & Refunds Policy. 7. Prescriptions and pharmacy

Prescriptions, if issued, are filled by licensed pharmacies. Some medications offered through the platform are compounded and are not FDA-approved; a compounded drug is not a generic version of, and is not equivalent to, any FDA-approved medication. See our Medication Safety page for details.

8. Acceptable use

You agree to provide accurate information, to use the services only for lawful purposes, and not to misuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to the platform. You are responsible for keeping your account credentials secure.

9. Intellectual property

The Cabana name, logo, site content, and design are owned by Cabana or its licensors and are protected by law. You may not copy, reproduce, or create derivative works without permission.

10. Third-party links

The site may link to third-party websites or services we do not control. We are not responsible for their content or practices.

11. Disclaimers of warranties

Except where prohibited by law, the services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 12. Limitation of liability
